By approving a work estimate, beginning a project with, conducting any business with, and/or purchasing any products/services from Honest House Creative, you agree to the full extent the below terms.
• ANY estimate(s) provided by Honest House Creative is exactly that, an estimate of time. This is not a guarantee of actual time nor is it a “not-to-exceed” time. Honest communication will be made If more time is needed than estimated to complete a task/job.
• No work will begin until estimate has been given written approval.
• Please submit any content you wish to be included in any design-related project digitally, such as an email, a digital file (ie. PDF, .DOC), or through our website forms. It takes additional time (and an additional cost to you) to type any handwritten content provided, including scanned revisions.
• Honest House Creative accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production, including any changes or amendment requested after final approval. We do the very best we can to make each piece perfect, but it is the sole responsibility of the client to proof every element.
• Our turn-around time ebbs and flows from project to project. If not stated in written documentation, we’ll be happy to discuss this at time of project beginning.
• For projects exceeding a total of $300, payment terms are 50% deposit to start the job and 50% at time of completion. Once a job has been completed, approved, and delivered to client, full payment is expected within two (2) weeks. Please communicate with us if a payment is expected to be later than two weeks.
• We work with several third-party printers that we trust but are NOT affiliated with. Any costs incurred for printing, reprints, printing errors, or other printing disputes will NOT be at the expense of Honest House Creative.
• Outside of the keywords and basic SEO we incorporate in your web site, we are not responsible for search engine promotion or marketing of any kind.
• Websites are developed and created using trusted, common, and up-to-date development standards. However, hacking attacks are a reality with any public website. Honest House Creative (and its people) are NOT for any security-related issues or breaches once a client website has been launched. If a breach were to occur, we will do what we can to assist in getting the compromised website back up and functioning properly.
• We retain full ownership of any design concepts and related materials we produce for any given project. Once a final concept/product is delivered to a client and full payment received, ownership rights of said concept transfer to the client. Unused concepts remain the property of Honest House Creative.
• Although we make an effort to check for errors, we are not responsible for proof-reading your content. The content given to us will be used “as provided.”
• Let’s be honest, have fun, and get things done. We (you and any Honest House Creative staff) agree to be realistic in: what can reasonably be achieved in a specific time frame, making the best use of resources to achieve the most effective outcomes, and displaying honesty in our work ethic.
Have all day?:
Any estimate(s) provided specify the allotted time frame that we believe is adequate to complete the job based on discussions, guidelines, and professional experience. This estimated time is not a guarantee of actual time nor is it a “not-to-exceed” timeframe. If more time is needed that estimated to complete a job – a member of our team will communicate with you (the client) regarding an increase in time. Honest House Creative’s billable time intervals are 15 minutes.
Any time needed for revisions, changes, and/or updates are used from original estimated time. During the event that there are additional requests after the project has begun, extra fees other than the price originally quoted will apply. Customer will be notified at the time of request of the additional fees.
As our name represents, we only strive to be 100% honest and fair with our processes, costs, and overall attitude. We only want to develop graphic and web design services that meet and exceed a client’s needs and expectations. After all, our goal is your satisfaction & happiness. We will communicate all estimated fees, and details prior to beginning any project.
No work will begin until estimate has been given written approval. It is agreed that the fee for service shall be the cost carefully estimated by Honest House Creative. If work undertaken exceeds the items & timeframe specified in the quote, you (the client) agrees to pay the appropriate fees for the excess work, outside the scope of the original agreement. You will always be notified of any estimate increases prior to continuing.
Digital vs. Handwritten Content:
Any content you wish to be included in any design-related project should be supplied to us digitally, such as an email, a digital file (ie. PDF, .DOC), or through our website forms. It takes additional time (and an additional cost to you) to type any handwritten content provided, including scanned revisions. If at all possible, please supply any textural content to us digitally.
Written approval of any estimate, project work (design-related or not), and contract signifies that you (the client) have approved ALL aspects of completed project. Honest House Creative accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production, including any changes or amendment requested after final approval. We do the very best we can to make each piece perfect, but it is the sole responsibility of the client to notify Honest House Creative of any errors during the revision cycle and before the final files have been completed. No refunds or reprints without additional cost are given after a final approved design has gone to print due oversights by clients proof reading.
Print Returns / Refunds:
It is agreed that Honest House Creative is NOT responsible or held liable for any errors contained in the final product after the final product has been approved by the client, (approval must be given in writing), committed to print or posted in view of the public.
In the event of a need to reprint due to errors in content, the client must inform Honest House Creative within 3 days of product acceptance, and return the product (at the cost of the client) within 10 days of acceptance for final assessment & further action to correct the issue.
Clients are given exclusive right to any completed logo design. All pre-designed and custom logos offered by Honest House Creative are created with absolutely no stock images, are 100% custom and 100% vector format (trade-standard). Any concepts that are not chosen and paid for remain property of Honest House Creative and CANNOT be used elsewhere per this policy.
Depending on the type of job, a small team of multiple designers/developers may need to be used to complete the project most efficiently.
Artwork & Stock Photography:
All work completed by Honest House Creative is created ‘from scratch’ or using our own stock photography library and commercially licensed fonts/graphics. If you have photography, fonts, or graphic elements you are welcome to provide those to us. We take no legal or ownership responsibility for any content provided to us by you, the client. This applies to any content uploaded to us via our website, email, external website, or provided to us using a physical storage device.
Concepts & proofs are presented via email and/or another specified method.
Our turn-time varies project to project, and can be discussed at time of project beginning.
Final product(s) will be provided to you in a market-standard print ready format, a physical printed form, or as digital source files (in the case of web development)
For any job exceeding a total of $300, payment terms are 50% deposit to start the job and 50% at time of completion.
We accept payment via check, cash, Paypal payments, and credit cards via Paypal
Once a job has been completed, approved, and delivered to client, full payment is expected within two (2) weeks, with a full payment period of no more than 30 days.
From time to time circumstances beyond the control of either party may result in the need for project cancellation. In the event of a terminated project, client is completely responsible for full payment of said invoice of any time spent by Honest House Creative up to that point at the standard hourly rate as determined in the project estimate. Additionally, in the event of the client canceling a project after a project has commenced and a 50% deposit has been made, the advance payment (deposit) will be forfeited by client in lieu of compensation to Honest House Creative. This covers design and administration time spent, resources purchased and allocated, research time and admin costs.
If a project is cancelled by Honest House Creative, including any of its partners, due to unforeseen circumstances, the 50% deposit will be refunded in full to the client in a timely manner. In the event of cancellation of the project by the client, ownership of all copyrights and the original artwork and disks shall be returned and retained by Honest House Creative and may be used by Honest House Creative in the future without limitations.
Any existing booking fees, delivery fees, design commencement fees, or progress payments are non-refundable and non-negotiable once work has commenced if project is terminated by the client.
A project is considered abandoned when no correspondence is received for 1 month time (30 days). After 30 days from last correspondence, any and all outstanding dues are still expected and payment is considered in default and subject to non-payment fees. Non-payment after 60-days will result in bad business karma and a collection notice.
Late & Non-payment:
We put a lot of dedication and care into each project we work on. Refusing to pay a bill without communication or reason, is simply unprofessional. We expect to receive payment no later than 30 days once a project has been approved and delivered. A non-payment fee of 20% of the total bill will be enforced after 30 days have passed. Non-payment after 60-days will result in a collection notice, and further legal action. Honest House Creative reserves full right to charge additional interest fees to unpaid invoices. Please be honest and pay your invoice. If, for some reason, you are having difficulty paying your invoice, or feel you have a reason to hold payment, please let us know of any reasons and issues so that we can formulate a solution that works for everyone.
Honest House Creative works with several third-party printers that we trust but are NOT affiliated with. In a rare case that a printing issue arises, we will work with the printers to get it resolved. Any costs incurred will NOT be at the expense of Honest House Creative.
Screen vs. Print:
Please note that print materials may show differently on a computer screen vs. a final printed piece. This is due to the fact of the interpretation of print standard CMYK colors on common RGB color computer monitors. Any reprints will NOT be at the expense of Honest House Creative. If color matching is a requirement, please let us know. We recommend providing Hex numbers or Pantone (PMS) numbers if you need exact hues matched.
It is agreed that any partners/employees of Honest House Creative and any affiliates shall not at any time either during the continuance of the work outlined or thereafter, except in the course of their duties, divulge any of the confidential affairs with the client or any of its clients or associated companies without the previous consent in writing of client.
From time to time, contracted employees may be hired as representatives of Honest House Creative for assistance and expertise in design-related projects. Any and all contracted employees of Honest House Creative are held to a confidentiality and non-disclosure agreement. Honest House Creative aims for complete security of our clients and we select contractors it is based upon previous work, references, and global checks with previous employers, as well as compliance with strict guidelines for professional ethics.
Web Design & Development Policies:
Web site designs are custom-created by Honest House Creative and are exclusive to each business. We reserve the right to use stock images, as required, as part of your web design template and any concepts not chosen and paid for will be a violation of Honest House Creative’s rights if they are used elsewhere.
• Websites are developed and created using trusted, common, and up-to-date development standards. However, hacking attacks are an unfortunate reality with any public website. Honest House Creative (and its people) are NOT responsible for any security-related issues or breaches once a client website has been launched. We never forsee related issues with websites we develop, however we are removed from any responsiblity with such occurrence. If a breach does occur, we will do what we can to assist in getting the compromised website back up and functioning properly.
Outside of the keywords and basic SEO we incorporate in your web site, we are not responsible for search engine promotion or marketing of any kind.
We reserve the right to add any completed projects to our portfolio. As standard and respected practice, a credit link of “site by Honest House Creative” (including the Honest House Creative logo as a small size) will be included at the bottom of your developed website. In the rare event of privacy contracts & policies, please notify us of any objections to this. Uninformed removal of the Honest House Creative credit constitutes a breach of these terms and conditions. Honest House Creative acknowledges the confidential nature of certain projects and agrees to only display project work once product/website has been publicly launched.
Web Design Revisions:
Our website design concepts include anywhere from 1 – 5 pages (depending on the scope of the project). Once web design is complete, Honest House Creative will provide the client with the opportunity to review the resulting work before making it “live” and open to the public. Honest House Creative will make one (1) set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include major changes to images, color palettes, patterns, navigation features, and large adjustments to layout / placement. Any minor changes can be notified to Honest House Creative by e-mail or via a website inquiry form. Honest House Creative will assume the client has approved the original draft, if no notification of changes is received in writing from the customer, within 14 days of the start of the review/proof period. A standard hourly fee after this 14-day timeframe for adjustments/revisions is applicable.
If time to make changes exceeds estimated project time – communication will be made and additional time will be billed at our standard hourly rate as required to complete project.
Web Design Content:
We are not responsible for proof-reading your content. The content given to us will be added to your website “as is” provided. Please take note that if many revisions are needed from the content you’ve provided us, our standard hourly fee applies to make those revisions.
Future Artwork / Additions:
A job is considered completed once the final version is delivered to the client in digital format, and written approval is given by client. The need of additional edits after approval, further design requirements, and/or extra files upon completion of a project will result in a new job creation and applicable fees as determined by Honest House Creative. The client will be informed that the alterations or changes requested fall outside the scope of the original estimate and must agree to a new estimate for the related additional cost.
Liability & Litigation:
It is agreed that all work and materials provided for clients by Honest House Creative will be free and clear of all liens and encumbrances and may be lawfully used by client without infringing upon the rights of others including, and without limiting the generality of the foregoing, any copyright trade secret patent or trade mark rights of any third party.
Under no circumstances shall Honest House Creative LLC be liable to client for any indirect or consequential loss suffered by client relying on the information included in any project prepared by Honest House Creative LLC including (without limitation) loss of profit, loss of contracts or economic loss. Liability to any third party for any reason is specifically excluded unless separately agreed in writing.
Honest House Creative retains full ownership of any design concepts and related materials it produces. Once a final concept/product is delivered to a client and full payment is received, complete ownership rights of the said concept transfer to the client. Unused concepts remain the property of Honest House Creative. Unless the client requests otherwise, Honest House Creative retains the right to display a small byline claiming design credit on works it produces, except for corporate stationery. This granting of strict copyright does not extend to the use of design proposals and concepts submitted to but not approved for the work outlined. Until final payment Honest House Creative retains ownership of all artwork and website architecture. Honest House Creative reserves the rights to certain elements used to create project content including fonts, patterns, stock images, textures, color palettes and other non-exclusive items.
Other than for the promotional use of Honest House Creative, all approved services provided shall be for the exclusive use of the client’s said purposes only. Designs may not be used for other promotional items, website or printed materials without permission. Honest House Creative reserves the right to use all artwork produced, concepts produced in the course of the project (including any concepts not chosen) and revisions for the purposes of promoting Honest House Creative in print or digital media portfolios, social media, blogs, except where the client has specifically requested in writing otherwise and is agreed to by Honest House Creative.
This written proposal assumes goodwill from both Honest House Creative, it’s partners, and all members of the client regarding:
- • What can reasonably be achieved in a specific time frame.
- • Making best use of resources to achieve the most effective outcomes.
- • Honesty in work ethic.
Graphic design, web development, design strategy, photography and marketing are all highly creative and often subjective art forms. As such Honest House Creative takes every possible care with professional advice offered and any suggested creative concepts and/or their implementation. However Honest House Creative cannot be held responsible for variations between expectation and outcome.
By approving an estimate, entering into a project with, and/or purchasing any products or services from Honest House Creative, you agree to be legally bound by the terms of all policies and procedures listed. Honest House Creative may modify these terms at any time.
